These terms govern your use of mitomoat.com (the “Site”), operated by Crest Advisory Group LLC (“Crest,” “we,” “us”) in connection with the MITO programme. By using the Site you accept them. If you do not accept them, please do not use the Site.

1. Information only

The Site is published for general information. It is not an offer to sell or a solicitation of an offer to buy any security, interest, product or service, it is not investment, legal, tax or accounting advice, and it is not a recommendation to enter into any transaction. It does not take account of your circumstances and should not be relied on as the basis for any decision. You should take your own professional advice.

2. No guarantee

Descriptions of the MITO system, its modules, verticals, integrations and anticipated availability describe capabilities that are designed to, and may, operate as described. They are illustrative and forward-looking. They are not guarantees, promises or commitments as to any result, feature, function, availability date, timeline, cost saving, operating expense, valuation, multiple, return or other performance, and no such outcome should be assumed. Actual results may differ materially.

Statements about verticals in progress, proposed or anticipated for a future quarter reflect present intention only. Roadmaps, scope, sequencing and timing are subject to change at our sole discretion, without notice.

3. Nothing binding until executed

Nothing on the Site, and no correspondence arising from the contact form, creates any contract, partnership, joint venture, agency, fiduciary duty, exclusivity or other obligation between us. No engagement, scope, deliverable, fee, equity participation or other commercial term is agreed unless and until it is set out in a written agreement executed by authorised signatories of both parties. Any discussion before that point is exploratory and non-binding, and either party may end it at any time.

4. Accuracy

We compile the Site with care, but we do not warrant that it is accurate, complete or current, and the Site is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We may change or withdraw any part of it at our sole discretion.

5. Confidentiality of what you send

Please do not send confidential or proprietary information through the contact form. Material submitted through the form is not treated as confidential and is not covered by any non-disclosure agreement unless one has already been executed between us and it covers the subject matter. Please do not submit personal data about other people.

6. Third-party links

The Site links to sites we do not control. We include such links for convenience and are not responsible for their content, availability or practices.

7. Intellectual property

The Site and its content, including text, design, layout, graphics and the MITO name and marks, belong to Crest or its licensors. You may view and print pages for your own reference. Any other copying, republication, adaptation or commercial use requires our prior written permission.

8. Liability

To the fullest extent permitted by law, we are not liable for any loss or damage, whether direct, indirect, incidental, special, consequential or punitive, including lost profits, lost opportunity or lost data, arising from your use of, or reliance on, the Site. Nothing here excludes liability that cannot lawfully be excluded, including for fraud or fraudulent misrepresentation.

9. Acceptable use

Please do not attempt to interfere with the Site, circumvent its bot verification or rate limits, submit unlawful or abusive material, or use it to send unsolicited commercial messages. We may decline or remove any submission at our sole discretion.

10. Privacy

Our handling of information submitted through the Site is described in the Privacy Notice.

11. Changes to these terms

We may revise these terms at our sole discretion. The version published here, with the date shown above, is the current one, and it applies to your use of the Site from the moment it is posted.

12. Governing law

These terms and any dispute arising from them are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules, and the state and federal courts sitting in Palm Beach County, Florida have exclusive jurisdiction, subject to any mandatory rights you may have under the law of your country of residence.
